Michael C. Wynne Wins Jury Verdict for Defendants in Grayson County Ownership Dispute — Judgment Cancels Lis Pendens

A Grayson County jury found in favor of defendants represented by Wynne, Smith & Young, PLLC in an ownership dispute involving two lumber-yard operations. After a two-week trial in the 397th Judicial District Court, the jury returned a defense verdict for Harold B. Rogers III and related defendants in Goins, Inc. v. Rogers et al., Cause No. CV-23-0220, following about 1½ hours of deliberation.

On October 21, 2025, the court entered final judgment for the defendants, awarding costs, canceling the plaintiff’s lis pendens, and denying claims for fraud, conversion, breach of fiduciary duty, and conspiracy. The judgment also provides for statutory interest.

The defense team was led by Michael C. Wynne, Board-Certified in Civil Trial Law and Personal Injury Trial Law by the Texas Board of Legal Specialization. Wynne and the WSY trial team prepared deed and title evidence, developed witness testimony, and presented legal defenses such as estoppel and superior title, persuading the jury to reject the plaintiff’s claims.

“This result reflects careful preparation, focused trial strategy, and rigorous advocacy before the jury,” Wynne said. “We are pleased the court confirmed our clients’ legal title and cleared the cloud on their property.”

Real property and business disputes often depend on documentary evidence, chain-of-title issues, and witness credibility. Early, thorough preparation and clear fact presentation are critical to protecting property rights.
